标准合同条款（StandardContractualClauses,SCCs,the“Clauses”）是欧盟委员会（EuropeanCommission,EC）发布的合同条款范本，专门针对包括欧盟在内的欧洲经济区成员国以及其他适用《通用数据保护条例》（GeneralDataProtectionRegulation或者Regulation(EU)/,GDPR）的法域向其他法域转移（“国际转移”或“跨境转移”）个人数据。[2]旧的标准合同条款根据年6月15日的//EC号决定发布且根据年5月15日的第/87/EU号决定修改，新的标准合同条款以（EU）/号决议于年6月4日发布，将于年6月24日生效，旧标准合同条款将于年9月27日正式废止。

修改标准合同条款的重要起因在于，年7月16日欧盟法院（theCourtofJusticeofEuropeanUnion,CJEU）通过“C-/18号案件—数据保护专员诉Facebook爱尔兰公司和MaximillianSchrems”一案（“SchremsII案”）[3]，判决从欧洲经济区向美国转移个人数据的便捷机制“隐私盾”框架无效，但是确认了通过签署标准合同条款将个人数据从欧洲经济区转移至美国仍然有效。而根据GDPR第5章，在提供了适当的保障措施确保充分水平保护后，个人数据可以从欧盟转移至境外第三国以实现跨境转移，由双方签署标准合同条款是6种保障措施之一。
